Supplemental Terms and Conditions for the Duolingo English Test

General

The Duolingo English Test ("DET") is operated by Duolingo, Inc. ("Duolingo"). Your use of the DET is governed by the Duolingo Terms and Conditions of Service ("Duolingo Terms") as well as these Supplemental Terms and Conditions for the Duolingo English Test ("DET Terms"). The DET Terms take precedence over any Duolingo Terms to the extent they conflict. Duolingo may amend the DET Terms at any time, and any such amendments will apply to all users who register for or take the DET after they are published. By registering for or taking the DET, you represent that you have read and understood, and agree to be bound by, the Duolingo Terms and DET Terms.

PLEASE NOTE THAT THESE TERMS AND CONDITIONS CONTAIN A MANDATORY ARBITRATION OF DISPUTES PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES IN CERTAIN CIRCUMSTANCES, RATHER THAN JURY TRIALS OR CLASS ACTION LAWSUITS. VIEW THESE TERMS HERE.

Test Rules

Duolingo may set and modify rules for taking the DET ("Test Rules"), which are incorporated into the DET Terms, in its sole discretion. Test Rules will be posted here or otherwise communicated to you before you begin the DET.

You must register for the DET using your real name and provide a form of identification from this list when you take the DET. Using a false name or false identification is a violation of Test Rules.

If Duolingo determines, in its sole discretion, that a user has violated any Test Rules, Duolingo may invalidate the user's test results, even if those results have been previously certified, and notify all third parties that have received the user's results of the invalidation. In cases of severe violations, Duolingo may ban a user from taking the DET again.

Any appeal of an invalid or invalidated result must be submitted to Duolingo within 72 hours.

Test Results Expiration

After you take the DET, you will receive a certificate containing your DET results and scores ("DET Certificate"). Your DET Certificate is valid for two years from the date you take the DET. After two years, your DET Certificate will be marked expired and you will no longer be able to share your DET Certificate with third parties.

Refund Policy

All payments are nonrefundable. There are no refunds or credits for expired, unused, or partially used test purchases or results, or for any premium processing service. There are no refunds if Duolingo invalidates your test or suspends your account because Duolingo determined that you violated the Test Rules, Duolingo Terms, or DET Terms.

However, if you are unable to complete the DET due to a failure in the test, or if you do not receive your DET results within a commercially reasonable period of time after the test is completed ("Test Issue"), Duolingo will, at its option, provide you with a refund or credit, or use reasonable efforts to resolve the Test Issue. To submit a claim based on a Test Issue, you must report the Test Issue in writing to Duolingo within 24 hours after the Test Issue occurs, respond to Duolingo's requests for information or cooperation, not be responsible for the Test Issue, and have met all requirements when taking the DET. Your refund for a Test Issue will not exceed the amount you actually paid for that test.

Coupon Codes

Duolingo may offer coupon codes that can be redeemed to take the DET ("DET Coupon Codes"). DET Coupon Codes have no dollar value and cannot be redeemed for a refund on past purchases. DET Coupon Codes are considered Promotion Codes under the Duolingo Terms and subject to the Promotion Codes section in the Duolingo Terms.

Some DET Coupon Codes may be sponsored by an authorized third party such as a university ("Code Provider"). If you redeem a Coupon Code sponsored by a Code Provider, you agree that Duolingo may share data on your use of the DET and your DET results with your Code Provider.

Use Restrictions

You may not do any of the following without Duolingo's express written permission:

Violate or circumvent any Test Rules, or otherwise cheat on the DET;
Impersonate another person while registering for or taking the DET;
Provide false information or documents when registering for or taking the DET;
Use more than one account to complete DET test sessions;
Alter or falsify your DET test results or DET Certificate;
Send an expired or invalid DET Certificate to any third party;
Give your DET username or password to any third party, or otherwise allow any third party to access your DET account;
Use the DET to collect information about Duolingo's testing process, or to develop test preparation material or a similar testing service;
Download, copy, distribute, create derivative works from, or offer for sale any information contained on, or obtained from or through, the DET;
Attempt to gain unauthorized access to any computer systems or networks relating to the DET;
Circumvent, remove, alter, deactivate, degrade, or thwart any technological measure or content protections of the DET;
Use any robot, spider, crawler, or other automatic device, process, software, or query that intercepts, mines, scrapes, or otherwise accesses the DET to monitor, extract, copy, or collect information or data from or through the DET, or engage in any manual process to do the same;
Use the DET for purposes other than obtaining a good-faith evaluation of your language skills and DET results; or
Use the DET in an illegal, harassing, unethical, or disruptive manner.

License to Use DET Software

Subject to your compliance with the Duolingo Terms, DET Terms, and Test Rules, Duolingo hereby grants to you, a personal, worldwide, royalty-free, non-assignable, non-sublicensable, non-transferrable, and non-exclusive license to install and use any software applications Duolingo provides to you as part of the DET for the sole purpose of taking the DET.

Limitation of Liability

In addition to the Limitation of Liability in the Duolingo Terms, DUOLINGO WILL NOT BE LIABLE FOR THE ACTIONS OR DECISIONS OF ANY THIRD PARTY, INCLUDING BUT NOT LIMITED TO ADMISSIONS, EMPLOYMENT, IMMIGRATION, OR VISA DECISIONS, EVEN IF THOSE ACTIONS OR DECISIONS ARE BASED ON THE DET OR INFORMATION DUOLINGO PROVIDED OR FAILED TO PROVIDE REGARDING YOUR PERFORMANCE ON THE DET. DUOLINGO'S LIABILITY TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY CAUSE WHATSOEVER ARISING OUT OF OR RELATING TO YOUR USE OF THE DET IS LIMITED TO THE AMOUNT YOU PAID FOR THE DET.

Privacy

Your use of the DET is also governed by Duolingo's Privacy Policy, a copy of which is located at www.duolingo.com/privacy, including the Supplemental Privacy Terms for the Duolingo English Test ("DET Privacy Terms"), a copy of which is located at englishtest.duolingo.com/privacy. By using the DET, you consent to the terms of the Privacy Policy, including the DET Privacy Terms.

Test Taker Content

Duolingo will own all rights to any writing samples or other responses you submit to DET questions, any audio or video recordings of you taken during the DET, and any feedback you choose to provide Duolingo regarding the DET ("Test Taker Content"). Subject to the DET Privacy Terms, Duolingo may use the Test Taker Content for any purpose.

No Third-Party Beneficiaries

The DET Terms are intended solely for the benefit of you and Duolingo. No third party may enforce any part of the DET Terms.

Termination

Duolingo may terminate your access and use of the DET immediately at any time, for any reason, and at such time you will have no further right to use the DET. You may terminate your DET account at any time by following the instructions available on the DET website. In addition to the sections identified in the Termination section of the Duolingo Terms, Sections 1-6 and 8-13 of the DET Terms will continue to apply following termination.

Injunctive Relief

You agree that your breach of these DET Terms will cause irreparable injury to Duolingo for which monetary damages would not be an adequate remedy, and Duolingo will be entitled to equitable relief in addition to any remedies it may have hereunder or at law without a bond, other security, or proof of damages.

Unproctored Placement Exam

Duolingo may sell Coupon Codes for an un-proctored version of the DET to approved institutional Code Providers (“Unproctored DET”). The Unproctored DET is intended solely for Code Providers’ internal use with their already admitted students, such as for placement exams.

For the Unproctored DET, Duolingo will have no human proctoring or review of the exam, will not collect student identification documents, will have reduced security procedures, and will not enforce most Test Rules. All other DET Terms apply to the Unproctored DET.

Students who take the Unproctored DET will not receive a DET Certificate or official score. However, they will receive an unofficial score valid for 2 years that will be shared solely with their Code Provider. The score will be marked as Unproctored on the Code Provider’s dashboard and will not be shareable with third parties.
